Terms & Conditions of Sale and Website Use
These Terms & Conditions govern (1) your use of the Remote Control Gates Company website and (2) the sale and supply of goods by Remote Control Gates Company (“we”, “us”, “our”). By using this website or placing an order, you agree to these Terms.
If you do not agree, please do not use this website and do not place an order.
Definitions
- Consumer: an individual buying goods mainly for personal use (not in business).
- Trade Customer / Business: any buyer purchasing in the course of business, trade, profession, installation, contracting or resale (including companies and sole traders).
- Goods: products supplied by us.
- Contract: the agreement formed when we accept your order and dispatch goods.
Orders and Contract Formation
Placing an order (online, email or telephone) is an offer to buy goods. A Contract is formed only when we accept the order and dispatch the goods (or otherwise confirm acceptance in writing).
We may refuse or cancel an order (for example, stock issues, pricing errors, fraud concerns). If payment has been taken, it will be refunded.
Prices and Payment
All prices are shown in GBP and include VAT where applicable. Delivery charges (and any express upgrades) are shown at checkout.
Payment must be received in full before dispatch unless agreed otherwise in writing.
Delivery
Delivery dates and times are estimates only. We are not liable for delays caused by carriers, suppliers or events beyond our reasonable control.
Please inspect deliveries promptly. Any visible damage, shortages or issues should be reported as soon as possible after receipt.
Risk and Title
Risk passes to you on delivery. Title (ownership) does not pass until we have received payment in full (including any delivery charges).
Cancellation, Returns and Refunds
Consumer cancellation rights and our returns process are set out in full in our Refund & Returns Policy. That policy forms part of these Terms.
Trade customers do not benefit from consumer cooling-off periods. Any trade returns are by prior written authorisation only and subject to the conditions in our Refund & Returns Policy.
Electrical Products and Installation
Many goods we supply are specialist gate automation and electrical components and may require professional installation and commissioning.
You are responsible for ensuring suitability, compatibility and correct installation. We recommend using a qualified professional. We are not responsible for damage or faults caused by incorrect installation, misuse, unsuitable system design, incorrect power supply, environmental conditions, or third-party equipment.
Warranty and Faulty Goods
Warranty claims are handled on a return-to-base basis and may require inspection/bench testing. Please contact us before returning any item.
Warranty covers repair or replacement of defective goods/parts only. It does not cover labour, call-out charges, travel, fitting/re-fitting costs or other associated costs.
This does not affect a Consumer’s statutory rights under the Consumer Rights Act 2015.
Limitation of Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under law.
Subject to the above, we are not liable for indirect or consequential losses. For Trade Customers, we are not liable for loss of profit, loss of business, business interruption, or economic loss, and our total liability is limited to the purchase price of the goods supplied.
Trade Customers
Orders placed using a company name, VAT number, trade account, trade pricing, or for installation/resale purposes will be treated as Trade purchases.
Trade customers are responsible for ensuring correct product specification and compatibility prior to installation. Returns (if any) are by authorisation only and may be subject to restocking/testing charges as described in our Refund & Returns Policy.
Website Use
Website content is provided for general information. While we aim to keep information accurate and up to date, product specifications and availability may change. If you require confirmation of compatibility/specification, please contact us before ordering.
